The true meaning of the werewolf game event for EOS community governance

It has been more than a week since the Werewolves game incident broke out and this case could lead to many interesting thoughts. For the course of events, you can refer to my previous article < DPOS consensus breakdown, BP collectively lost their voice >.

It can be said that hitherto there are no public chains that is more creative and imaginative than EOS. On the other hand, what is the future of EOS community’s governance like?

According to the EOS.IO Constitution,Article X — Choice of Law: Choice of law for disputes shall be, in order of precedence, this Constitution and the Maxims of Equity.

The Maxims of Equity mentioned here is one of the most commonly used concepts in Anglo-American legal system, or what is commonly known as “case law”, and the corresponding concept is Civil law system (China belongs to the Civil law system).

The civil law system’s mode of operation is to first have legislation and then judicial, judicial interpretation is carried out if there is any problem. In contrast, Anglo-American legal system’s characteristic is “judge-made decisional law”. Legislation is not required in prior, but it directly paints the country’s laws through judicial practice in different cases.

Therefore, in the Anglo-American legal system, judges play a very important role and have very big power. As a result, the moral requirements of judges are also very strict which results in the role often being passed down through a mentoring system, as we need generations after generations of legal persons with a sense of social responsibility and conscience. Otherwise, Anglo-American legal system could be led down a more nefarious path than the other legal systems.

Let’s return to the Werewolves game incident. At present, a total of 258786.39 EOS is involved in this case, which might not seem big in the entire EOS community. If the community is required to involve in arbitration every time a similar fraud incident happens, the judicial costs will greatly increase. Due to various considerations, this incident did not receive adequate attention from ECAF. However, we still have to point out something that sets this incident apart from others is: this could be a fraud project which was initiated by a block producer candidate and confirmed participation from elected block producers in helping with publicity and also benefiting financially.

Elected block producers play a significant role in the EOS community, with credibility in the ecosystem and could even influence the development direction of the entire community. Hence, if even elected block producers are unable to restrain themselves with good will and conscience, and participate in EOS governance voting with purely their own interest in mind, then EOS will be thoroughly reduced to a tool to maximise their personal benefits. ECAF’s current mode of operation seems to have forgotten its fundamental purpose is to represent justice and fairness. When ECAF and EOS Constitution have become tools or lifeless decorations, how do we continue to revere them and hold our expectations of them?

From the previous discussions with ECAF, we can also know that the current EOS community governance in the real world mainly referenced the Anglo-American legal system. Although there was no agreement in the EOS Constitution on the consequences block producers would have to bear for violating users’ property rights, it is still possible to use “Maxims of Equity” to grate on both parties’ conscience, in order to pass fair judgements, which will then be organized and become judicial precedents, and finally become the formal legal source of EOS governance law.
